TERMS & CONDITIONS

Kindly agree to the following prior to booking a studio or virtual class:

CLASS VALIDITY

  • Single class - valid for 4 weeks from date of purchase

  • Package of 3 sessions - valid for 4 weeks from date of first session

  • Package of 4 sessions - valid for 6 weeks from date of first session

  • Package of 5 sessions - valid for 8 weeks from date of first session

  • Package of 10 sessions - valid for 16 weeks from date of first session

PAYMENT POLICY

All classes are payable in advance. Cash is accepted if paid prior to the chosen lessons.

DOOR POLICY

Out of courtesy to your trainer and fellow participants, we ask that you arrive on time for your scheduled class.

CANCELATION POLICY

If you need to cancel your session, please do so 24 hours in advance. For anything less than this, you unfortunately will still be charged.

REFUND POLICY

PULSE does not offer any full or partial refunds. In extreme circumstances such as physical or mental inability to continue with the sessions, refunds may be allowed if a doctors note is provided and alongside the owners approval.

MEMBERSHIP POLICY

  • By signing up to PULSE Virtual Community, he/she is responsible for ensuring he/she is properly equipped, and that his/her state of health and physical condition are such as not to involve any risk to him/herself or any other person. It is hereby understood and agreed the trainer accepts no responsibility for accident, injury, or illness suffered.

  • No classes will take place on bank holidays, or over the Christmas festive season, unless otherwise mentioned by the instructor

INDEMNITY POLICY

I certify that I am in good health and fit to undertake the chosen lessons at my own risk. I agree to communicate any change in health with the instructor of the class prior to the class date and to take part in any/all exercise at my own risk.

To PULSE Pilates Ballet Barre, hereinafter referred to as "the studio": I am aware that I am using any equipment or programming presented at the Studio at my own risk and assume full responsibility for any injuries or damages which may occur. I hereby fully and forever release and discharge the studio, its owners, employees and agents from any and all claims, demands, damages, rights of action, or causes of actions, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of my use or intended use of any equipment at the Studio and or my participation in the programming or attendance at the Studio. The Studio shall not be liable for the loss or theft of, or damage to any personal property at the Studio.

LIABILITY RELEASE

I understand that participating in any group or private class at PULSE may include a wide range of physical movements. As is the case with any physical activity, the risk of injury, is always present and cannot be entirely eliminated.


If at any time during the class, I feel discomfort or strain, I will gently come out of the posture/exercise. I may rest at any time during the class.It is important that you listen to your body, and respect its limits on any given day.


I understand that any group or private class at PULSE is not a substitute for medical attention, examination, diagnosis, or treatment. If in doubt, I should consult a physician prior to beginning any activity program.

 

I recognise that it is my responsibility to notify my teacher of any serious illness or injury before every class.

 

I will not perform any postures/exercise to the extent of strain or pain.

 

I accept that neither the teacher, nor PULSE, is liable for any injury, or damages, to person or property, resulting from the taking of any class.

 

Client Waiver

Please read each of the following statements to confirm understanding and acceptance

1. I understand that any group or private class are not a substitute for medical care and that prior to my lesson I have informed the teacher of all known medical conditions and injuries.


2. I agree to inform the teacher of any changes in my health and medical condition during my lesson. I understand there shall be no liability on the teacher’s part if I fail to do so.


3. This release and any disputes or claims arising out of or in connection with it or its subject matter (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of United Kingdom, its courts shall have exclusive jurisdiction.


4. By accepting this release, I hereby waive and release my independent teacher as well as PULSE from any and all liability, past, present and future relating to the class.


Data protection notice


To ensure your well-being and for our records, we at PULSE require you to check this form before creating an account with us. 

PULSE may store the information that you provide on ACUITY SCHEDULING.INC. In addition, the teacher may take notes of the information that you provide and/or which she observes. This may include details about your health past & present. Such notes will be electronically stored by us in order to enhance your experience with PULSE. They will be stored and made available to any independent teachers hired by PULSE.

Your personal details will never be shared with any other company other than PULSE.

By purchasing a package, filling in a contact form on our website (www.pulsepilatesballetbarre) / Acuity Scheduling Online Booking System, or using a mobile app, you agree and accept that we may gather, process, store and/or use the personal data submitted in accordance with the terms set below.

 

If you are under the age of 16, PULSE will not collect or process your details unless we have also received the consent of an adult who has parental responsibility for you.

 

Personal Data Collected

 

Identity and contact details of the data processor

 

Personal data collected by us and stored via our website or mobile app is processed on our behalf by ACUITY SCHEDULING, INC. 

 

Your data is stored in the UK. From time to time it may be made visible to employees of PULSE & ACUITY SCHEDULING, INC.

 

The data processor and its group are required by us to process your data in strict compliance with the GDPR.

 

Purposes of processing and legal basis

 

The principal purpose of collecting your personal data is to provide you with the services defined in your membership agreement. To this end, you agree and accept that we may use your personal data to:
 

• Contact you in respect of your membership

• Manage your purchased packages

• Facilitate member rewards (if applicable)

• Resolve any problems you may have and improve our service to you

• Comply with our legal and regulatory obligations
 

We use the personal data submitted to us only in accordance with the applicable data protection legislation. Our employees and third-party providers are under an obligation to respect your data privacy.

 

Marketing

 

If you consent, we may send you marketing information by e-mail or sms about products and services which we believe may be of interest to you. We will always provide the ability to review or change your preferences or unsubscribe from marketing information with immediate effect. Data we collect

 

When you sign up to PULSE via our website (www.pulsepilatesballetbarre.co.uk) or via the ACUITY SCHEDULING, INC booking platform, or in person at our studio, the following personal data may be collected and processed in accordance with the purpose and legal basis described above and may include: name, address, contact details (including e-mail and mobile phone number), gender, date of birth, attendance history, marketing preferences and bank details for billing. Some data is collected automatically through using our website (see section 3.7 below).

 

Certain features of our mobile app may connect to your social networking sites to enable you to follow or be followed by other members of PULSE. As a result, PULSE, may process information from your social networking profile, but only if you consent to allow your social networking site to make information available to the app.

 

Obtaining or changing your details PULSE can confirm to you the details of any personal data we hold about you and how it is processed on your request. You may also ask us to correct or delete personal information we hold about you at any time, so long as this information is not required in order to fulfil our service to you.

Mobile app users are able to maintain some of their personal data directly. Note that if your account is in arrears you will be unable to use this functionality and you will be directed to contact us accordingly.

Third party disclosures

 

Your data will not be shared with any other third-party service providers without obtaining your prior consent. Any third parties that we may share your data with are obliged to keep your details securely, and to use them only to fulfil the service they provide you on our behalf. When they no longer need your data to fulfil this service, they will dispose of your details in line with PULSE procedures.

 

We will never pass your personal information to anyone else, except where we are required or permitted to do so by law, for any successors in title to our business and suppliers that process information on our behalf both in the UK and abroad. We may also use and disclose information in aggregate (so that no individual customers are identified) for marketing and strategic development purposes.

 

Cookies

 

A cookie is a small amount of data, which often includes a unique identifier that is sent to your computer browser from a website’s computer and is stored on your device’s hard drive in the form of a text file.

Our web site may contain links to other web sites which are outside our control and are not covered by this Privacy Notice. If you access other sites using the links provided, the operators of these sites may collect information from you which will be used by them in accordance with their privacy notice, which may differ from ours.

 

Data Retention Period

 

As a prospective member that has consented for us to contact you, PULSE will retain your data until notify us that you no longer wish to be contacted. 

 

Your rights as a data subject

 

At any point while we are in possession of or processing your personal data, you, the data subject, have the following rights:

a) Right to be informed – you have the right to know how your personal data is being used

b) Right of access – you have the right to request a copy of the information that we hold about you.

c) Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.

d) Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records.

e) Right to restriction of processing – if you believe the basis for processing your data as described in section 3 of this notice no longer applies or if you contest the accuracy of the information we hold about you, you have a right to request restrictions to the processing of your data.

f) Right of portability – you have the right to have the data we hold about you transferred to another organisation.

g) Right to object – you have the right to object to certain types of processing such as direct marketing.

h) Right to object to automated processing, including profiling – you also have the right to not be subject to the legal effects of any automated processing or profiling. Note that if Pilates Hub Weybridge refuses a request from you under rights of access, we will provide you with a reason as to why.

 

Finally, if a data breach occurs which compromises your personal data, you have a right to be informed within 72 hours of us first becoming aware of the breach.

If you believe that your data is being processed unfairly or you have any other concerns about the way that PULSE or it’s designated processor is handling your data, you have the right to complain to the Information Commissioners Office (ICO). Please visit www.ico.org.uk for more information.

PULSE reserves the right to update this Privacy Notice at any time, in particular pursuant to any changes made to the laws and regulations in force.
